2. Obligations under Union industrial security law shall apply to the United Kingdom in cases where the tendering, award or grant award procedure for the classified contract, subcontract or classified grant agreement has been initiated before the end of the transition period. In particular, this Protocol shall not prevent the United Kingdom from concluding agreements with a third country which grant preferential access to the market of that country to products manufactured in Northern Ireland under the same conditions as products manufactured in other parts of the United Kingdom. IN VIEW of the fact that the withdrawal of the United Kingdom from the Union therefore poses significant challenges for the maintenance and development of North-South cooperation, such an agreement can be concluded by any means of communication. DESIRING to establish appropriate arrangements for achieving the objectives of the arrangements provided for in Protocol No 3 following the withdrawal of the United Kingdom from the Union, STRESSING that the orderly withdrawal of the United Kingdom from the Union in respect of Gibraltar entails possible negative effects on the close social and economic relations between Gibraltar and the surrounding region, in particular, the territory of the municipalities which make up the Mancomunidad de Municipios del Campo de Gibraltar in the Kingdom of Spain is adequately treated, the communication must specify the provisions that the complainant intends to suspend. Before deciding to suspend parts of an agreement under point (b), the complainant shall first consider whether the suspension of the provision of that agreement under point (a) would be an appropriate response to the breach.
