A Doctor’s Opinion On The Supreme Court’s Decision On The Affordable Care Act

By upholding The Affordable Care Act, the Supreme Court has ignored the Constitution, and has confirmed what those who read the bill knew all along that the bill was a tax . In doing so they have placed corporate interests and profits along with government control above the needs of the doctor and the patient. This decision guarantees the destruction of the doctor patient relationship, and with it individualized healthcare, innovation and access while perpetuating the worse aspects of our medical system. Because of the mandate, Americans will be forced to pay for a system that will increase costs for patients, remove healthcare decisions from both the doctor and the patient, and lead to rationing thereby changing healthcare as we know it to a system based on one size fits all, cost controlled, conveyor belt socialized medicine. With this decision, it is clear that patient-centered medicine has effectively ended.

    …’the supreme court has ignored the constitution’…your assumption that you know more about the constitution than a legislative branch and a judicial branch makes me wonder what else you could be wrong about. If you’re going to vehemently oppose a solution at least suggest one that does not perpetuate the cost of health care reaching almost 20% of GDP while millions remain uninsured and die. Tax/penalty, call it what you want…someone probably had to pay a tax to help you get your education…someone also paid a tax in blood or treasure to ‘change America as we knew it’…or else you might not even had been allowed to attain your education.

      Justice Roberts in his decision stated that the law was unconstituional based on the commerce clause

      In addition to this, I don’t believe this bill is constitutional based on:

      Article 1 section 7:

      All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

      – The final bill which was sent to the president for signature originated in the Senate and not the House of Representatives, this would make it an invalid law

      Article 1 Section 8

      The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

      Due to the deals made to pass the bill “Louisiana purchase” and ‘The cornhusker kickback” Louisiana and Nebraska do not share the same tax burden for healthcare as the rest of the country.

      As a doctor I have sworn an oath to make the best interests of my patients my primary goal. I take that very seriously. You and I both want the same thing affordable, excellent healthcare that is accessible to all. However, after personally seeing how government intervention (regulations and compliance), and corporate control by middlemen such as the insurance companies, pharmaceutical companies, and corporate hospitals have put profits over patient care, I believe that forcing people to buy health insurance will make the situation worse.

      I see insured patients and over the past 12 years in private practice, I have seen them have less ability to receive recommended healthcare either because of insurance denials or they simply can’t afford it because their out of pocket expenses are so high (despite coverage). There is nothing in the ACA that will change this. Frankly, there is nothing in it that will stop insurance companies, medical device companies, or hospitals from passing their increased costs to patients…. It is a disaster.       A suggestion is to stop wasting time with personal attacks and make a committment to do your own research. When you do so you will find that there is a difference between healthcare reform and medical insurance reform, and that having health insurance does not equal good healthcare. In doing this you will stop following a meme that is designed to inflame, divide and distract while empowering the status quo. i.e, the classic Hegalian dialectic

    Typical response from a supporter of this monstrosity.Most have never read 5 pages of this bill ,but get their talking points from hacks on MSNBC .Personal attacks are the Alinsky way. It is also a sign of someone who is speaking from an orifice that they sit on

    Dr. George, I am so glad I found your blog. I am so fearful of what our country has done. I am afraid for my parents as they are aging seniors, and my children for how their country has abandoned them and have heaped this huge burden on their backs. I feel stressed and overwhelmed a ll of the time over all that has happened in the last 3 years, which is unhealthy! It seems that no matter what anyone says people who love the political left do not realize the predicament we have been put in. AND, they put such stock in these human being who have faults. ALL OF THEM on both sides of the aisle! What do I do, what do we do, now as a people? How do we really fight this? How do we go on fighting against people who think socialism is good? Have they read history? Do they not get that it is always the downfall of society & nations?

    Please see my most recent blog (The Antidote for Affordable Care Act). I believe that patients and doctors should choose not to participate in this corrupt system.
    Proponents of this system want you to be discouraged and give in. If you decide to take back your power they will lose. This system cannot stand if a Americans decide to stop playing the game.

    So you think we passed this bill just to piss you off? Really? LOL. I pbolarby shouldn’t bother to answer this as it is an asinine question but here goes. The insurance regulation alone is what sold it to me. No more dropping people from policies because the company considers acne a pre-existing condition, no more caps on how much a company will pay. It doesn’t go far enough, but we can make those changes incrementally. And just so we are clear here, I have no issue with moderate intelligent Republicans.Ask a snotty, condescending question, what do you think you will get? Ask a respectful question, you get respectful answers. There, that was easy.
